Agreement

These terms govern your use of buildsites.io and every service BuildSites provides: website design and development, hosting and maintenance, automation, custom software and related work. By using the site, booking a call, submitting a form or signing a proposal, you agree to them. Where a signed proposal or order says something different, the proposal wins for that project.

Text message (SMS) program terms

These terms apply to every text message program run by BuildSites. By opting in you agree to them and to our Privacy Policy.

Program name and description

BuildSites operates two SMS programs from our business number, (437) 476-9312:

• BuildSites Customer Messages (non-marketing): conversational and transactional messages about your inquiry, appointment scheduling and reminders, project updates, and account notifications such as invoices, payment confirmations and service or outage alerts.
• BuildSites Promotions (marketing): special offers, discounts, and new product or service updates.

Each program has its own consent checkbox on our form at buildsites.io/contact. Both boxes are unchecked by default and optional; consent is not a condition of submitting the form, booking, or purchasing any product or service. You may also opt in to Customer Messages by texting us first or by agreeing during a call or in writing.

How to cancel (opt out)

You can cancel the SMS service at any time. Just text "STOP" to (437) 476-9312 or reply "STOP" to any message you receive from us. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again. Replying STOP to a message from one program unsubscribes you from that program; text STOP ALL to leave both.

Carrier liability

Carriers are not liable for delayed or undelivered messages.

Message frequency and rates

As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive up to 4 Customer Messages per month (more only while a project or booking is active) and, if you opted in to Promotions, up to 4 promotional messages per month. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Age restriction

You must be at least 18 years old and the account holder or authorised user of the mobile number you provide to opt in to text messages from BuildSites.

If you have any questions regarding privacy, please read our privacy policy: https://buildsites.io/privacy. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes.

Plans, pricing and term

• Our published plans are monthly: Website $297, Automation $297, Website + Automation $445, in Canadian dollars plus applicable taxes (HST in Ontario, GST and QST in Quebec). Custom work is quoted in writing.
• Each plan has an initial term of 12 months, billed monthly. There is no upfront build fee; the first monthly payment is due when your site or automation goes live.
• After the initial term the plan continues month to month at the same price. You can cancel with 30 days' written notice. If you cancel before the initial term ends, the remaining months of that term are due.
• Prices may change for new terms with at least 30 days' notice; they do not change during a term you have already started.

What is included

Website plans include design, copy, build, launch, hosting, SSL, uptime monitoring, security updates, nightly backups and content edits as described on our pricing page. Automation plans include the workflows described there, running on the phone number, inbox and calendar you already use, plus monitoring and adjustments. Online stores, customer portals, custom software, paid advertising, photography and third-party subscriptions (for example text-message carrier fees, typically $20 to $40 a month) are not included unless your proposal says so.

Your responsibilities

• Provide the content, logo, access and approvals we need on time. Our 48-hour launch clock starts when we have them.
• Make sure you have the right to use everything you give us (text, photos, trademarks) and that your business, offers and claims comply with the law.
• Keep your own logins confidential and tell us promptly if you think an account has been compromised.
• Do not use our services for anything unlawful, deceptive, harmful or that sends unsolicited messages in breach of CASL or carrier rules.

Ownership

Your domain name, your content, your customer data and the accounts we set up in your name are yours from day one. The website itself becomes yours, including its code and design, when the initial 12-month term is complete and all amounts are paid; until then we grant you an exclusive licence to use it. If you leave, we hand over the site, domain and any data cleanly within 14 days of your request. Tools, templates and know-how we reuse across clients remain ours.

Payment

Invoices are due on receipt by Interac e-Transfer or card. Amounts more than 15 days overdue may accrue interest at 1.5% per month (19.56% per year) and, after written notice, we may suspend hosting or services until the account is settled. You are responsible for any bank or processing fees on your side.

Changes, revisions and support

Content edits are included in every plan as described on the pricing page. Larger changes, new pages beyond your plan, redesigns or new features are quoted separately. We aim to respond to support requests within one business day and to resolve outages as fast as possible; our monitoring checks every minute.

Warranties and limits

We build carefully and test before launch, but no website or automation can be guaranteed to be error-free, uninterrupted or to produce a particular business result. Third-party services we rely on (hosting, domain registries, messaging carriers, payment processors, APIs) may change or fail; we will work around them but are not responsible for their outages. To the extent the law allows, our total liability for any claim is limited to the fees you paid us in the 12 months before the claim, and we are not liable for indirect losses such as lost profits or data. Nothing here limits liability that cannot be limited by law.

Termination

Either of us may end the agreement for a material breach that is not fixed within 15 days of written notice. We may suspend services immediately for non-payment, unlawful use or a security risk. On termination you pay for work done and, if inside an initial term, the balance of that term. We then hand over your assets as described under Ownership.

Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Disputes will be heard in the courts of Ontario, except that clients in Quebec may bring claims in Quebec as their consumer-protection and civil law allow. We will always try to resolve problems by talking first.

Changes to these terms

We may update these terms; the date at the top shows the current version. Changes apply to new agreements and, for existing clients, at the next renewal unless the change is required by law.
